TERMS AND CONDITIONS - DISCLAIMER SOUL Touring®

A few words from SOUL Touring®…

We look forward to taking you on one of our tours through the Western Cape in South Africa. We'll aspire to make your trip with us as enjoyable as possible so you will look back on the Cape with fond memories.
To minimise misunderstandings, please take note of our terms and conditions.

1, Tour booking form
Your signature on the booking form confirms your acceptance of these terms and conditions as a binding contract between SOUL Touring® and yourself, the participant. Soulriding Tours cannot accept any tour participant without a duly signed booking form.

2, Payment
At the time of booking a deposit of 40% of the total tour price is required. This deposit secures your place on the tour. The balance is due 30 days before the tour starts. If the total balance is not received 30 days before the tour starts, SOUL Touring® reserves the right to cancel your reservation and retain your deposit. Bookings recieved less than 30 days prior to start of the tour (should places be available) must be paid in full.

3, Cancellation procedure Cancellation of any booking must be received in writing and acknowledged by SOUL Touring®. If the cancellation is received 31 days or more prior to the departure date, the full deposit shall be forfeited. If SOUL Touring® has less than 30 days notice, the cancellation fee will be payable as follows: 21 to 29 days prior to departure 40% of total fare 14 to 20 days prior to departure 60% of total fare 7 to 13 days prior to departure 80% of total fare 0 to 6 days prior to departure 100% of total fare If the participant fails to join a tour or joins it after departure, or leaves it prior to its completion, no reimbursement will be made. Please note: Travel and cancellation insurance is highly recommended for all clients. The onus is on the client to arrange this travel insurance at the time of booking. If unforseen circumstances prevent you from taking your place on the tour, you may, for the additional fee of R500 transfer your holiday to a third party up to 13 days before the start of the tour. However we will require notification of this in writing for our approval. Please note that SOUL Touring® will hold you personally responsible for paying the total amount of the tour and the additional R500. The new client must sign a form with the acceptance of our terms and conditions.

4, Tour cancellation by Soulriding Tours
Should a tour for unforseen circumstances, be cancelled by SOUL Touring®, we will either refund full payment or offer an alternative tour.This refund only refers to bookings made through SOUL Touring® in South Africa.
If SOUL Touring® has to curtail a tour after departure for any pertinent reason, i.e. wars, strikes, severe weather conditions or acts of God, then SOUL Touring® will not be held liable for any form of refund.
Pls note the minimum number of particitants on a tour is 4 people, we have the right to cancel a tour if this number is not reached, however we endevour to start all tours booked.

5, Authority and exclusion from tour
SOUL Touring® takes no responsibility for the actions of participants who commit any unlawful acts in South Africa. SOUL Touring® reserves the right to exclude any client from the tour, if their behaviour warrants it.

6, Baggage
Baggage insurance is recommended as SOUL Touring® can assumes no responsibility for loss, damage or delay in delivering baggage to tour participants. Baggage turned over to SOUL Touring® for transport each day is done so at participant's own risk.

7, Health
The client should familiarise him/herself with the tour itinerary and confirm that they are medically fit to undertake the tour. Any participant with a known medical illness or condition must reveal this fact, at the time of booking, and make the necessary arrangements for the provision of any drugs or treatments that may be needed during the tour.
Such clients will be required to provide a medical certificate from his or her doctor, to confirm that they are physically fit to travel.
SOUL Touring® will hold this information in the strictest of confidence.
It is necessary to have a comprihensive medical insurance for this trip, and we prefer you to have a comprehensive accident insurance. During participation in cycle races in South Africa you have to state your medical health insurance cover.
The client takes part in this sports cycle holiday at his or her own risk. The client is responsible for knowing and obeying the traffic laws of South Africa. SOUL Touring® can not take any responsibility for road accidents involving a client.

8, Vaccinations For South Africa there are no innoculation requirements. The Western Cape is malaria free. For more information please contact your local tropical institute. 9, Travel documentation It is the participant's responsibility to ensure that he/she is in possession of a valid passport, visas and all relevant travel documentation needed for South Africa. Should a client be denied entry into South Africa for any reason or due to incorrect documentation, SOUL Touring® will not be held responsible for any costs and delays that may occur.

10, Responsibility
SOUL Touring® aspires to keep the information on our website correct and up to date. We however do not accept any responsibility for any content of externally linked sites.
SOUL Touring® is responsible for providing the services listed in the tour description according to the local standards and the accurate description of services offered in its literature. Although SOULRIDING TOURS carefully selects and constantly checks its contractors, such as hotels, transport and restaurants, it cannot be held responsible for any deficiencies of services offered by local companies.SOUL Touring® is not responsible or liable for any personal accidents. SOUL Touring® reserves the right without prior notice to change any particulars of the tour.

11, Applicable Law
This Agreement shall be governed by the laws of South Africa. The Customer irrevocably submits to the jurisdiction of the courts of Cape Town, South Africa.
